1. Maybank Photography Awards Contest (the ‘Contest’) is organised by Malayan Banking Berhad [insert partners] (the ‘Contest Organiser’).
2. The “Contest” starts on 1 August 2013 00:00 and will run until 31 October 2013 at 23:59 pm.
3. The “Contest” is open to all ASEAN country residents aged 18 and above as of 1 August 2013.
4. There is no time restriction or requirement on when images must have been captured.
5. The participant ("the Participant") participating in the “Contest” agrees to all terms and conditions outlined below.
6. Please read these terms and conditions (the “Terms and Conditions) carefully. By accessing this “Contest,” “Participants” signify their agreement with and understanding of the following Terms and Conditions and the legal information pertaining to both this “Contest” and any material on it. If “Participants” do not agree to these “Terms and Conditions,” please do not participate in this “Contest.”
7. The “Contest Organiser” reserves the right to change these “Terms and Conditions” at any time without notice to the “Participant.” The “Participant” is therefore responsible for regularly reviewing these “Terms and Conditions.” Continued participation of this “Contest” following any such changes shall constitute the “Participant’s” acceptance of such changes.
8. Members, employees or immediate family of Maybank’s Marketing and Brand Management staff, its agents, contest partners, or anyone else connected to the administration and execution of the “Contest” may take part in this contest but they are not eligible to win any prizes.
9. No purchase is necessary.
Winners and judging criteria
1. Entries will be judged by the appointed panel of judges against criteria including but not limited to aesthetics, technical execution, image quality and appropriateness to and interpretation of the contest theme. A “Participant”’s image must be the best image as determined by the panel of judges in order to win.
2. Images must meet minimum size criteria in order to be suitable for exhibition, should they win. The minimum size for submission is 2000x3000 pixels.
3. The “Contest Organiser’s” decision is final. No correspondence or any other form of communication regarding the “Contest” will be entertained.
4. “The Participants” may enter a maximum of 10 unique photos for each category in all categories except Photographer of the Year and Press Photography. Repeat submissions are not permitted.
5. The “Participant” must enter a body of work consisting of a minimum of five images for the Press Photography Category.
6. The “Photographer of the Year” must be a finalist in at least two categories, or the winner of one. It is the aim of the competition that the Photographer of the Year display talent across multiple subjects and genres, being able to execute work to a consistently high standard.

8. Selection of winners will be at the sole discretion of the “Contest Organiser.”
9. Selected images will be displayed on the “Contest” website. If an image is displayed, it has been shortlisted by the judging panel and is eligible to win a prize in its respective category.
10. The “Contest Organiser” reserves the right to shortlist and display images. The shortlisting decision is final and no correspondence or any other form of communication regarding the decision will be entered into.
11. Preliminary short listing of images will be undertaken ‘blind’ by one panel of judges; the final judging will be undertaken by a separate panel of judges. To ensure fairness, names and other personal identifying characteristics of participants will not be visible to judges.
12. The “Contest Organiser” aims to deliver prizes at the “Awards Ceremony”, though we reserve the right to ship larger items.
13. All winners will be notified by email. All details of the prizes and in particular the terms of their attribution and use will be provided by notification to the winners. In the email to the winner, some information may be requested in order to enable the good delivery of the prize. In the event that the winner does not provide the requested information, a reminder will be sent by email. Should the winner not respond to the reminder email by providing all requested information within twenty-four hours, the prize shall, to the extent permitted by applicable law, be automatically forfeited by this Participant and Maybank reserves its right to grant the prize to another Participant.
14. Personal details will not be shared with any third party and information will not be used for any other purpose than to contact individuals with matters arising from the contest.
15. Finalists are required to resubmit their images in the highest resolution available via electronic or physical means within 48 hours of notification. Failure to do so will result in disqualification. In the event of the finalist being a winner, the prize will be withdrawn and awarded to the next qualified winner at the discretion of the judges.
16. In the event a winner fails to respond within 48 hours after notification of winning or is otherwise disqualified from the contest, that prize will be withdrawn and awarded to the next qualified winner.
17. Winners are required to attend the “Awards Ceremony” to receive their prize. Transportation and accommodation for any winners residing outside Kuala Lumpur and Selangor will be provided at the expense of the “Contest Organiser” if applicable.
18. No interest will be paid on any prize. Prizes are not transferrable.
19. The “Contest Organiser” reserves its sole right and discretion to (a) award an alternative prize of an equal or greater value and (b) in exceptional circumstances to vary, amend or withdraw this competition on reasonable notice.
20. The “Contest Organiser” reserves the right, in its sole discretion, to disqualify any individual found tampering with the “Contest” process or the operation of the “Contest”.
21. Winners may be required to take part in post-event publicity, and agrees that their Full Name and/or their photos be published by Maybank in any publicity materials.
22. Winners are bound by the “Terms and Conditions” that come with the prizes. The acceptance of the prize indicates the acknowledgment and agreement of such “Terms and Conditions.”
23. To the extent permitted by applicable law, the “Contest Organiser” does not accept any responsibility for any damage, loss, injury or disappointment suffered by any The “Participant” entering the “Contest” or as a result of non-allocation or acceptance of any prize. Maybank is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to the “Participant’s” or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in relation to the “Contest.”
24. By participating in the “Contest,” you agree that no claim shall be asserted against Maybank, its parent companies, partners or affiliates or any of their respective directors, officers, employees or agents in respect of any and all losses or injuries (including without limitation special, indirect or consequential losses), damages, rights, claims or actions of any kind whatsoever that result from your participation to the “Contest” and/or non-allocation of any prize and/or your acceptance or use of any prize.
Image ownership and intellectual property
1. By entering an image, the “Participant” attests that he or she produced the image and is the rightful owner to the copyright of the image. “Participants” entering images not belonging to them will be disqualified.
2. By entering an image, the “Participant” agrees to grant Maybank and its partners and affiliates a limited and royalty-free license to use the image in relation to promotion of the “Contest” and any future “Contests”, including publication online, in print, on television, within Malaysia and internationally.
3. By entering an image, the “Participant” attests that the image is not subject to any form of existing exclusive commercial or editorial license.
4. Model and/or property releases may be required for certain images in the event of publication.
5. Images previously entered in other competitions and contests are acceptable so long as submission does not violate any existing agreements, terms and conditions etc. already in force from the prior competitions.
6. A winning or finalist image from the 2012 Maybank Photo Awards may be resubmitted but is ineligible for winning any prizes.
7. All image rights remain property of the photographer.
Final notes
1. The “Contest Organiser” reserves its sole right and discretion to delete, remove, ignore or reject photos that are deemed improper or offensive in any manner, or which violate the “Terms and Conditions”.
2. The “Contest Organiser’s” decision is final. No correspondence or any other form of communication regarding the “Contest” will be entertained.
